Confidentiality and Volunteer Agreement

Purpose of Policies   
These policies are written to provide overall guidance and direction to members, staff,and volunteers engaged Warriors And Rodeo efforts. These policies do not constitute, either implicitly or explicitly, a binding contractual or personnel agreement. Our agency reserves the exclusive right to change any of these policies at any time and to expect adherence to the changed policy.

Definition of 'Volunteer'
A "volunteer" is anyone who, without compensation or expectation of compensation beyond reimbursement, performs a task at the direction of and on behalf of the agency. A "volunteer" must be officially accepted and enrolled by the agency prior to performance of the task. Unless specifically stated, volunteers shall not be considered as "employees" of the agency.

Volunteers Under 18
Any volunteers or member under the age of 18 are required to have a parent sign any document as acknowledgment of all expectations.

Service at the Discretion of the Agency
Our agency accepts the service of all volunteers and members with the understanding that such service is at the sole discretion of the agency. Volunteers and members agree that the agency may at any time, for whatever reason, decide to terminate the volunteer's or member's relationship with the agency.
The volunteer or member may at any time, for whatever reason, decide to sever the volunteer's/member's relationship with the agency. Notice of such a decision should be communicated as soon as possible to Warriors And Rodeo President.

Representing WAR
Volunteers/Members are asked to not contact organizations or individuals on behalf of WAR unless they are given express written directions to do so by the Project Manager. Prior to any action or statement which might significantly affect or obligate the agency, volunteers should seek prior consultation and approval from appropriate staff. These actions may include, but are not limited to, public statements to the press, coalition or lobbying efforts with other organizations, or any agreements involving contractual or other financial obligations. Volunteers/Members are authorized to act as representatives of the agency as specifically indicated within their Warriors And Rodeo job descriptions and only to the extent of such written specifications.
ASSUMPTION OF RISK AND RELEASE OF LIABLITY. This is a release of liability. By becoming a volunteer/member of WAR, you are agreeing to release WAR and all other parties from liability. Please read carefully.
I, for and in behalf of myself and my spouse, children, parents, next of kin, heirs, representatives, successors and assigns, expressly waive and release from any and all claims for personal injury, death, property damage or any other claim that I have now or may have in the future against WAR and SmithPRO LLC, it’s parents, subsidiaries, affiliates, members, officers, directors, employees, agents, contractors, laborer, officials and sponsors, and WAR sanctioned, approved or affiliated events and their respective affiliated, associated, related, parent or subsidiary companies and their respective officers, directors, members, employees, contractors and agents, from any and all claims, demands, suits and liabilities for any and all property damage, personal injury, death or other responsibility asserted or adjudged against me by any third parties arising from my participation or other involvement in sanctioned, approved and affiliated events or other activities.  I agree to discharge, waive, release and covenant not to sue WAR, all WAR sponsors, all Members, SmithPRO LLC and any other entity involved with WAR. This discharge, waiver and release also includes claims, demands, and liabilities by a Member for indemnities and contributions arising from property damage, personal injury and/or death to a third party. This provision shall be binding upon me, as well as upon my spouse, children, parents, next of kin, legal representatives, heirs, successors and assigns.
Confidentiality
All Warriors And Rodeo members and volunteers are responsible for maintaining the confidentiality of all proprietary or privileged information to which they are exposed while serving as a volunteer, whether this information involves a single staff, volunteer, client, or other person or involves overall agency business. Failure to maintain confidentiality may result in termination of the volunteer's relationship with the agency or other corrective action.

NON-COMPETE AGREEMENT
The member/volunteer shall not own, manage, operate, consult or be employed in a business substantially similar to, or competitive with, the present business of WAR or such other business activity in which the Company may substantially engage during the term of employment.
This non-compete agreement shall be in full force and effect during the period of volunteer status and for 2 years following employment termination, notwithstanding the cause or reason for termination.
This agreement shall be binding upon and inure to the benefit of the parties, their successors, assigns, and personal representatives.
Please contact Warriors And Rodeo is you have a possible Non-Compete issue and we will see if can resolve it as we want you to be involved with this organization.
Screening/Reference Checks
For some tasks, volunteers/members must submit samples of work and professional references. If such is required, it will be outlined in the task description.
Copyright/Ownership Issues
War member hereby grants non-exclusive permission to Warriors and Rodeo for use of any materials produced for WAR, including graphics materials, web page designs, narratives, research, compilations, instructional texts, etc., becomes the property of WAR upon submission. Volunteers will receive credit on the WAR site for these and other contributions.
Contacting Other Volunteers/Members
Occasionally, members will need to contact other members with regard to their activities with WAR. We expect all such communications among members to follow general guidelines. Other than email addresses WAR members will not share contact information about a member with another member without the express consent of all parties involved. We encourage members to use common sense when communicating with other members -- or anyone -- online. We suggest your following this rule: don't reveal anything about yourself online to someone that you would not feel comfortable revealing to a stranger you met on the street.
Inappropriate Communications
If at any point you receive any e-mail that you feel is inappropriate, for any reason, and you believe you have received it in conjunction with your involvement with the WAR, please forward the email and other details about the communication to the WAR Manager.
Dismissal of a Volunteer/Member
Volunteers/Members who do not adhere to the rules and procedures of the agency are subject to dismissal. No volunteer/member will be terminated until the that person has had an opportunity to discuss the reasons for possible dismissal with supervisory staff. Possible grounds for dismissal may include, but are not limited to, the following: gross misconduct or insubordination, theft of property or misuse of agency materials, abuse or mistreatment of clients, staff or other volunteers, failure to abide by agency policies and procedures, and failure to satisfactorily perform assigned duties.
